These Terms and Conditions ("Terms") govern the rental of vehicles supplied by Petromare ("we", "us", "our") at 19 Jalan Wira 9, 47000 Sungai Buloh, Selangor. By signing a rental agreement or by paying a booking deposit, you ("the Renter") agree to these Terms.
1. The Agreement
Each rental is documented in a written rental agreement that lists the vehicle, the rental dates, the pick-up and drop-off points, the price in Malaysian Ringgit (RM), the authorised driver or drivers, and any optional items such as a child seat. The rental agreement and these Terms together form the full contract between you and Petromare. Where there is a difference between the two, the rental agreement controls.
1.1 Capacity
You confirm that you are at least 21 years of age, hold a valid driving licence, and have the legal capacity to enter into this contract under Malaysian law.
2. Driver Requirements
The Renter and any additional driver listed on the rental agreement must hold one of the following:
- A valid Malaysian driving licence (Class D or equivalent) held for at least one year.
- A valid driving licence from your home country, together with an International Driving Permit, where Malaysia accepts that permit.
Original documents are required at handover. We do not accept photographs or scans in place of the originals. Anyone not named on the rental agreement may not drive the vehicle.
3. Booking & Payment
Bookings can be made by phone, by email, or in person at our office. A booking is confirmed once we have your dates, identification details, and a booking deposit. The remaining balance is paid on the day of handover, before the keys are released.
All prices on this website are quoted in Malaysian Ringgit (RM) and include the applicable Sales and Service Tax. Where a rental is supplied to a registered business, an invoice will be issued in the business's name on request.
4. Deposit
A refundable security deposit is taken at handover, set against the cost of the vehicle category. The deposit is held to cover possible costs that may arise during the rental โ for example, traffic summonses, fuel adjustments, or repair of damage that is not the responsibility of the insurance partner. The deposit, less any agreed deductions, is returned within seven working days of the vehicle's return.
5. Vehicle Use
The vehicle may be used only:
- For private vacation travel on public roads in Peninsular Malaysia.
- By the named drivers on the rental agreement.
- Within the laws of Malaysia, including all road traffic regulations.
The vehicle may not be used:
- For commercial transport such as taxi, ride-hailing, or courier work.
- For motor sport, off-road driving, or training.
- To carry goods or passengers beyond the legal capacity stated in the registration document.
- To carry any item that is restricted or prohibited under Malaysian law.
- Outside Peninsular Malaysia without our written agreement in advance.
Smoking and the carriage of pets inside the vehicle are not allowed. Where these rules are not followed, a cleaning fee may be deducted from the deposit.
6. Insurance
Each vehicle is covered by a comprehensive motor insurance policy with a Malaysian insurer. Standard cover includes third-party liability, fire, and theft, with an excess set by the insurer. The Renter is responsible for the excess amount in the event of damage that is the Renter's fault. Optional reductions to the excess are available on request and are listed in the rental agreement where taken.
Personal items left inside the vehicle are not covered by the motor policy and are the responsibility of the Renter.
7. Fuel & Mileage
The vehicle is handed over with a full fuel tank and should be returned with a full tank. Where the tank is not full at return, the difference will be charged at the local pump price plus a small handling fee, which is shown on the receipt.
Most rentals include a fair-use mileage allowance set per day. Longer touring rentals are quoted without a daily cap; the relevant figure is recorded in the rental agreement.
8. Cancellation
You may cancel a booking by writing to us at [email protected] or by calling +60 19-857 3624 during opening hours. Where cancellation is made:
- More than seven days before the rental start date โ the booking deposit is fully refunded.
- Between seven and two days before the start date โ a portion of the booking deposit is retained to cover preparation costs, as set out in your rental agreement.
- Less than two days before the start date โ the booking deposit is retained in full.
Petromare may cancel a booking where the vehicle has become unavailable for reasons outside our reasonable control. In that case the full booking deposit is refunded and, where possible, we will offer an alternative vehicle of the same category.
9. Liability
Petromare's liability to the Renter is limited to direct losses that arise from our failure to meet these Terms. We are not liable for indirect or consequential losses such as missed flights, lost holiday time, or onward booking changes. Nothing in these Terms limits any liability that cannot be limited by Malaysian law.
10. Governing Law and Jurisdiction
These Terms and any rental agreement made under them are governed by the laws of Malaysia. Any dispute that cannot be resolved through direct discussion is to be brought before the courts of Selangor, Malaysia. We will, where possible, try to resolve any matter through a written exchange before formal action is taken.
